Terms and Conditions
1. EQUIPMENT.
Any dumpster(s) (“Equipment”) Clutter Cleanout Junk Removal furnishes to Customer shall remain Clutter Cleanout Junk Removal’s property. While the Equipment is in Customer’s possession, Customer is liable for all loss or damage to the Equipment, except for normal wear and tear. Customer shall provide safe, unobstructed access to the Equipment on pick-up day.
2. INVOICES; PAYMENT TERMS.
Customer must pay in advance to Clutter Cleanout Junk Removal on a per dumpster basis (Reservation Fee of $449). By accepting Service, Customer agrees to all terms & conditions. Customer agrees to pay Clutter Cleanout Junk Removal the invoiced amount ($449 + a 3.8% convenience) prior to delivery. After the reservation fee is paid, customer agrees to pay a per pound overage rate of $.10/lb for what they put in the dumpster (if over 6,000lbs), once the dumpster is dropped off for customer’s rental period. After the rental is done and Clutter Cleanout Junk Removal dumps the dumpster at the landfill, the customer will be charged a dump fee overage invoice for the $.10/lb (if over 6,000lbs), plus any additional charges stated in the rental agreement that pertains to their individual rental.
If full payment of the Charges (Dump Fee Overage Invoice from Landfill) is not received by Clutter Cleanout Junk Removal within three (3) days from the date of the invoice, Customer will be assessed a late fee as specified on the invoice, which shall be for the past due amounts accruing from the date of the invoice, with a late fee of $150. Customer acknowledges that such late fee is not to be considered as interest or debt on a finance charge but rather is a reasonable charge for the anticipated loss and cost to Clutter Cleanout Junk Removal for the late payment.
Additionally, if Customer fails to timely pay an invoice, Clutter Cleanout Junk Removal may pursue legal action (after 30 days) to retrieve payment. If Services are suspended or terminated by Clutter Cleanout Junk Removal due to Customer’s breach of these terms or if Customer terminates the Services, Customer understands and agrees that Clutter Cleanout Junk Removal will not refund, or pro-rate or return any amounts previously paid by Customer to Clutter Cleanout Junk Removal.
3. CUSTOMER RESPONSIBILITY:
Clutter Cleanout Junk Removal is not responsible for any damage beyond the curb line. We can place the container wherever dictated by the customer but cannot be responsible for cracked driveways, broken concrete, water lines, underground tanks, rust spots, damaged fencing or landscaping (including lawns), septic systems, etc. that occurred due to placement of the container whether by the delivery truck or the container itself.
Customer must assure a minimum of 15’ overhead clearance for all power, phone, internet, cable, and any other lines/structures/trees. Customer releases Clutter Cleanout Junk Removal and holds harmless CCJR against all claims, and damage to property arising out of CUSTOMER’S use, operation, or possession of the roll-off container. Company shall not be liable to CUSTOMER for failure to perform the services due to events beyond its control, including but not limited to strikes, riots, fires, floods, and governmental actions, changes in law, weather, traffic, or acts of God. Customers should mark and advise all drivers of possible hazards prior to delivery. Driver retains the right to deny placement in a requested location based upon safety and/or site considerations.

4. Logistics Efficiency Fee
Logistic efficiency fees apply when Clutter Cleanout Junk Removal’s services/routes have been hindered, due to customer. Logistic efficiency fees will ONLY be invoiced if one of the following conditions are met:
• Clutter Cleanout Junk Removal must come back on-site after departing to move a dumpster, after it’s already been placed and approved by customer on-site through in-person or over-the-phone communication = ($100 Fee)
• Customer moved the dumpster themselves, without approval from Clutter Cleanout Junk Removal = ($159 Fee)
• DRY RUN FEE – Customer is not prepared for dumpster delivery, so Clutter Cleanout Junk Removal could not deliver/pick-up the dumpster, and will have to reschedule for new delivery/pick-up = ($159 Fee)
• ON-SITE CANCELLATION FEE – Clutter Cleanout Junk Removal delivered a dumpster off for the customer; they change their mind and need it removed (NO REFUND ISSUED, CLUTTER CLEANOUT WILL KEEP THE WHOLE RENTAL RESERVATION FEE)
Customer will be notified beforehand if this billing is required.
5. Cancellation Fee
Customer agrees that Clutter Cleanout Junk Removal reserves the right to keep 50% of the $449 reservation fee if customer cancels service after payment has been received to cover costs of overhead. If the customer refuses delivery after the driver is on site and states (they canceled the order), and we do not have proof they attempted to cancel, then a DRY RUN FEE ($159 Fee) will be assessed.
6. Late Payment Fee
If you fail to pay your dump fee overage/additional charges invoice 3 days after the invoice is issued, Clutter Cleanout Junk Removal reserves the right to charge you a late payment fee. Late payment fees are intended to help Clutter Cleanout Junk Removal recover its costs incurred in managing customers’ unpaid accounts. Late payment fees are set by each operating subsidiary, at the amount of $150.
7. Convenience Fee
All services provided by Clutter Cleanout Junk Removal (including equipment rental) are subject to a convenience fee of 3.8%. All electronic payments have convenience fees that are charged to Clutter Cleanout Junk Removal by payment processors, hence passed to the customer.
